01Introduction
These Public Website Terms and Conditions ("Website Terms") govern your access to and use of the public-facing website operated by TrustBridge Global Foundation ("TrustBridge," "we," "us," or "our").
Please read these Website Terms carefully. By accessing or using the Public Site (as defined below), you acknowledge that you have read, understood, and agree to be bound by these Website Terms.
If you do not agree to any of these Website Terms, kindly refrain from accessing or using the Public Site.
02Definitions
For purposes of these Website Terms:
- "Public Site" means the publicly accessible informational website made available by TrustBridge at or through trustbridgeglobal.com (including public pages, public language/country versions, and publicly available resource pages and downloads) that link to or display these Website Terms. The Public Site does not include Secure Areas (defined below) or Controlled Workflows (defined below), even if accessible through links on the Public Site.
- "Secure Areas" means any TrustBridge or TrustBridge-branded website, portal, or environment that requires authentication (for example, login credentials, account access, or other access controls), and any similar controlled environment.
- "Separate Terms" means any other terms, conditions, policies, disclosures, notices, instructions, or agreements that TrustBridge or a third party presents in connection with a specific service, secure environment, application, transaction, or relationship.
- "Controlled Workflows" means any donation, grant, payment, application, onboarding, account, fund, or other process that includes gated steps, identity verification, compliance checks, confirmations, payment submissions, or other transactional functionality.
- "Content" means all content made available on the Public Site, including text, articles, guides, reports, videos, graphics, logos, design, layout, and other materials.
- "You" and "your" means any person who accesses or uses the Public Site.
03Document Hierarchy
These Terms govern only the Public Site.
If you use a part of the TrustBridge ecosystem that is subject to Separate Terms, those Separate Terms govern that activity. In the event of any conflict between these Terms and Separate Terms relating to a specific secure area, application, transaction, fund, or service, the Separate Terms control for that specific matter.
Our Privacy Policy explains how we process personal data collected through the Public Site. Our Cookie Notice or cookie controls, where presented, explain our use of cookies and similar technologies. Privacy and cookie notices are not a substitute for transaction, portal, or fund terms.
TrustBridge may manage, administer, operate, host, support, or facilitate all or part of the Public Site and related communications through partners, vendors, contractors, advisors, hosting providers, software providers, analytics providers, and other service providers. Where you interact with the Public Site, information you submit or generate may be accessed, shared, or processed among those entities to the extent reasonably necessary to operate, host, secure, analyze, maintain, improve, or support the Public Site, respond to inquiries, route you to an appropriate TrustBridge or partner solution, comply with law, or protect TrustBridge, its users, and the communities it serves. Personal data processing, cross-border transfers, and related safeguards are described more fully in the Privacy Policy and any applicable Separate Terms.
Without limitation, Separate Terms may include terms applicable to Fund Holders, Fund Advisors, Successors, Authorized Persons, account or portal users; the TrustBridge Foundation Fund and Charity Fund Terms and Conditions; GivingSpace or other secure portal terms; donation, contribution, payment, application, charity onboarding, grant recommendation, grant request, distribution, or transaction terms; and partner-specific, network-member-specific, or jurisdiction-specific terms, disclosures, and policies.
04Acceptance
General browsing (notice-based use). TrustBridge makes these Website Terms available via the Public Site. By continuing to access or use the Public Site, you agree to these Website Terms.
Interactive points (express assent). For certain interactions—such as submitting a contact form, requesting a consultation, subscribing to newsletters or updates, downloading certain resources, or clicking through to a controlled workflow—TrustBridge may require you to provide express assent (for example, by checking a box or clicking a button stating that you agree to these Website Terms and/or other terms). Where TrustBridge requires express assent, that express assent controls your use of the relevant feature or interaction.
Other terms may apply. If you access Secure Areas or Controlled Workflows, additional terms and policies apply.
05Changes to These Website Terms
We may update these Website Terms from time to time to reflect changes to the Public Site, our practices, or legal requirements. We will post the updated Website Terms on the Public Site and update the "Last updated" date.
If changes are material, we will use reasonable efforts to provide additional notice via the Public Site (for example, a banner or notice). Your continued use of the Public Site after updated Website Terms are posted constitutes acceptance of the updated Website Terms.
06Eligibility and Geographic Availability
The Public Site is intended for a general audience and may be accessed worldwide. However:
- The Public Site and Content are provided for informational purposes and may not be appropriate or available in all jurisdictions.
- TrustBridge may limit access to the Public Site or certain Content in any region or jurisdiction at any time, including to comply with applicable laws, sanctions, export controls, and other legal requirements.
- If you are under the age of 18 (or the age of majority where you live), you may browse the Public Site, but you should not submit forms, provide personal data, or otherwise engage with interactive features without the involvement and consent of a parent or legal guardian.
07Permitted Use of the Public Site
Subject to these Website Terms, TrustBridge grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Public Site and Content for your personal or internal informational purposes.
You may print or download reasonable portions of Content for lawful, non-commercial use, provided that you do not remove any copyright, trademark, or other proprietary notices and you do not alter the Content in a way that misrepresents TrustBridge or the Content.
08Prohibited Conduct
You may not, and may not attempt to:
- use the Public Site for any unlawful, fraudulent, misleading, abusive, harmful, or unauthorized purpose;
- interfere with, damage, disable, overburden, or compromise the Public Site or any related systems, security features, or infrastructure;
- access non-public areas, accounts, data, or systems without authorization;
- nefariously use bots, crawlers, scrapers, harvesting tools, or similar automated means to access, copy, monitor, or extract Content or data from the Public Site, except as may be allowed by TrustBridge and to the extent permitted by applicable law and any applicable robot instructions;
- frame, mirror, or republish the Public Site or Content in a way that suggests endorsement, affiliation, or ownership by you or a third party;
- introduce viruses, malware, malicious code, or other harmful material;
- impersonate another person or entity, misstate your affiliation, or submit false or misleading information through the Public Site;
- infringe the intellectual property, privacy, publicity, confidentiality, or other rights of TrustBridge or any third party;
- use the Public Site in connection with sanctions evasion, money laundering, terrorism financing, fraud, phishing, or other prohibited activity; or
- use the Public Site in any way that could create an unreasonable burden on TrustBridge's systems or interfere with other users' access.
TrustBridge may take reasonable technical and operational measures to protect the Public Site and its users.
09Intellectual Property and Trademarks
Ownership. The Public Site and Content are owned by TrustBridge or our licensors and are protected by intellectual property laws, including copyright and trademark laws.
Trademarks. "TrustBridge Global," "TrustBridge Global Foundation," and related logos, slogans, service marks, and brand features are trademarks or service marks of TrustBridge or its licensors. You may not use any TrustBridge trademarks without our prior written permission.
No implied rights. Except for the limited license expressly granted in these Website Terms, nothing in these Website Terms grants you any rights in or to the Public Site, Content, trademarks, or other intellectual property of TrustBridge or any third party.
10User Submissions and Communications
The Public Site may allow you to submit information or materials to TrustBridge (for example, via contact forms, consultation requests, newsletter sign-ups, or inquiry submissions) ("Submissions").
Appropriate content. You agree that your Submissions will be accurate to the best of your knowledge and will not be unlawful, defamatory, infringing, or otherwise inappropriate.
Sensitive information through approved channels only. You may provide sensitive information only through secure channels or AI-enabled tools that TrustBridge specifically authorizes for that purpose. Please do not submit highly sensitive personal information through Public Site forms, chat functions, or other publicly accessible features unless TrustBridge instructs you to do so.
AI-enabled tools may produce incomplete, inaccurate, or outdated responses and should not be relied on as legal, tax, financial, charitable, or other professional advice.
How we use Submissions. To the extent your Submissions are not personal data, you grant TrustBridge a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such Submissions for the purpose of responding to you, operating the Public Site, and improving our communications and services. If your Submission includes personal data, our collection and use of that personal data is governed by our Privacy Policy (see "Privacy and cookies" below).
Unsolicited ideas. If you send TrustBridge suggestions or ideas that we did not request, you understand that we may use them without restriction or obligation to you (including without confidentiality or compensation), unless required otherwise by applicable law.
11Fraud Awareness and High-Level Compliance Safeguards
TrustBridge and our users may be targeted by fraud attempts (including phishing, spoofed emails, and deceptive communications). You are responsible for taking appropriate precautions, including safeguarding your credentials.
TrustBridge may communicate important security guidance on the Public Site. If you believe you have received a suspicious communication purporting to be from TrustBridge, do not provide sensitive information and contact us using the contact details listed in these Website Terms or on the Public Site.
To protect TrustBridge, its mission, and the communities we serve, we may restrict or refuse access to the Public Site where we reasonably believe it is necessary to address fraud, misuse, unlawful activity, or compliance with sanctions and similar legal requirements.
12Informational-Only Content and Disclaimers
The Public Site provides general information about TrustBridge and cross-border philanthropy topics, and may describe giving structures and solutions (such as donor-advised giving, international granting, non-cash gifts, fiscal sponsorship concepts, impact investing concepts, and dual-taxpayer giving solutions).
Informational purposes only. All Content on the Public Site is provided for general informational purposes only. It may not be current, complete, or applicable to your circumstances. You should not rely on the Public Site as the sole basis for making decisions.
No professional advice. Nothing on the Public Site constitutes legal, tax, accounting, investment, financial, or other professional advice. You should consult qualified professional advisers regarding your specific situation, including the cross-border legal and tax implications of any charitable activity.
No offer, no solicitation. Nothing on the Public Site constitutes an offer to sell, a solicitation, an invitation, or a recommendation to purchase or invest in any financial instrument or service, or to enter into any transaction. Any services offered by TrustBridge are provided only under separate terms, disclosures, and agreements through controlled workflows.
No fiduciary relationship from browsing. Your use of the Public Site does not create a fiduciary relationship, agency relationship, advisory relationship, or client relationship between you and TrustBridge. Any such relationship, if applicable, arises only through separate written terms and agreements specific to the relevant program or service.
13Philanthropy and Cross-Border Disclaimers
The Public Site may describe Donor-advised Funds, Cross Border Grants, Charity Funds, Foundation Funds, Non-cash Gifts, Fiscal Sponsorship, Mission Related Investment, Dual-tax Giving, Legacy Planning, or related solutions. Those descriptions are high-level only.
For clarity:
- acceptance of contributions is subject to TrustBridge's review, policies, and applicable law;
- charity onboarding, due diligence, and approval are not guaranteed;
- grant recommendations and distribution requests remain subject to TrustBridge's review, legal control, discretion, and applicable law and policy;
- processing times, jurisdictions, exchange rates, assessments, tax outcomes, and operational availability may vary; and
- separate terms, disclosures, partner arrangements, or controlled workflows may apply before any donation, fund, grant, or other solution is made available.
The Public Site does not alter or replace any Separate Terms applicable to donations, funds, grants, accounts, secure portals, or other controlled workflows.
14Third-Party Links and Third-Party Services
The Public Site may contain links to:
- third-party websites, tools, videos, platforms, or services;
- social media channels;
- payment or transaction providers; and
- separately governed TrustBridge platforms or secure environments.
Those links are provided for convenience only. TrustBridge does not control, and is not responsible for, the content, availability, security, terms, policies, or practices of third-party websites or services.
If you choose to access a third-party site or a separately governed TrustBridge platform, you do so at your own risk and subject to the terms and policies applicable there.
References on the Public Site to a charity, donor-advised fund, network member, partner, bank, payment provider, technology provider, service provider, or other third party do not constitute a guarantee of availability, approval, eligibility, suitability, or continued relationship. Separate terms, policies, and disclosures of those entities may apply, and TrustBridge does not guarantee that any donation, application, onboarding, grant, or other interaction involving such an entity will be accepted, completed, or available in your circumstances.
15Privacy and Cookies
TrustBridge's collection and use of personal data through the Public Site is described in our Privacy Policy, which is available on the Public Site.
The Public Site may use cookies and similar technologies. Information about cookies and similar technologies, and any cookie controls or preference tools we provide, are described in our Privacy Policy and/or a cookie notice or cookie controls presented to you on the Public Site (as applicable).
16Availability; No Warranties
We strive to maintain the Public Site, but we do not guarantee that it will always be available, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Public Site at any time.
To the maximum extent permitted by applicable law, the Public Site and Content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
17Limitation of Liability
Nothing in these Website Terms excludes or limits liability to the extent that it cannot be excluded or limited under applicable law.
To the maximum extent permitted by applicable law:
- TrustBridge will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or related to your access to or use of (or inability to access or use) the Public Site or Content;
- TrustBridge is not liable for the acts, omissions, content, terms, or practices of third parties, including external websites, platforms, tools, service providers, or linked resources; and
- TrustBridge's aggregate liability for direct damages arising out of or related to the Public Site or these Website Terms will not exceed CHF 100.
Swiss-law carve-out. Nothing in these Website Terms excludes or limits TrustBridge's liability for unlawful intent (willful misconduct) or gross negligence, and any mandatory rights you may have under applicable law remain unaffected.
18Indemnification
You agree to indemnify and hold harmless TrustBridge and its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your breach of these Website Terms;
- your unlawful use of the Public Site; or
- your infringement of any intellectual property or other rights of any third party through your Submissions or use of the Public Site.
This indemnity is limited to the extent permitted by applicable law and does not apply to the extent that the relevant claim arises from TrustBridge's unlawful intent or gross negligence.
19Suspension and Termination
We may suspend, restrict, or terminate your access to the Public Site at any time if we reasonably believe it is necessary to protect the Public Site, TrustBridge, users, or third parties, or to address fraud, misuse, security risks, or legal compliance requirements.
Sections of these Website Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
20Governing Law and Forum
These Website Terms and any dispute or claim arising out of or relating to the Public Site or these Website Terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules.
Subject to mandatory law, the competent courts at TrustBridge's registered seat in Switzerland have exclusive jurisdiction over any dispute arising out of or relating to these Website Terms or the Public Site.
Mandatory consumer protections. If you are a consumer and mandatory laws grant you rights (including consumer protection rights or rights to bring proceedings in a different forum), nothing in these Website Terms is intended to exclude or restrict those mandatory rights.
21Miscellaneous
Severability. If any provision of these Website Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No waiver. A failure by TrustBridge to enforce any provision is not a waiver of that provision.
Entire agreement for Public Site use. These Website Terms form the entire agreement between you and TrustBridge regarding your use of the Public Site, and supersede any prior or contemporaneous communications on that subject. For clarity, separate terms govern Secure Areas and Controlled Workflows as described above.
Assignment. You may not assign or transfer these Website Terms without TrustBridge's prior written consent. TrustBridge may assign these Website Terms as part of a reorganization or similar corporate transaction consistent with applicable law.
22Language
These Website Terms may be made available in multiple languages for convenience. If there is any conflict or inconsistency between versions, the English version will prevail to the extent permitted by applicable law.
